The US International Trade Commission recently ruled that crystalline silicon photovoltaic products imported from China and Taiwan will cause substantial damage to related industries in the United States, and the US government will continue to conduct "double-reverse" investigations on such products. This is the second time since November 2011 that the United States has launched a “double-reverse†survey on China's photovoltaic products. According to the US investigation procedure, the US Department of Commerce will make a preliminary ruling of subsidies around March 28, 2014, and make a preliminary dumping before and after June 11, 2014. The industry believes that if the United States decides to levy taxes, the photovoltaic industry will encounter comprehensive restrictions, and the situation of many enterprises will be worse. It is noteworthy that in the United States, the sanctions against China's photovoltaic products have intensified, and the formation of "full encirclement", the US polysilicon industry has evaded sanctions through processing trade and other means, making China's "double-reverse" taxation measures ineffective, and the industry has called for greater counter-measures. Strength.
Earlier, the US Department of Commerce issued an announcement on January 23rd, deciding to launch an anti-dumping and countervailing merger investigation on PV products imported from China. The products involved in this investigation are crystalline silicon photovoltaic cells, whether they are individually, partially or completely assembled. Other products, including but not limited to batteries, components, laminates, panels and building integration materials. Between 2010 and 2012, China’s exports to the United States accounted for $1.52 billion, $3.12 billion, and $2.08 billion, respectively.
In fact, the US Department of Commerce proposed a “double-reverse†investigation on China's photovoltaic cells in November 2011, and in 2012, it imposed an anti-dumping duty of 18.32% to 249% and a countervailing duty of 14.78% to 15.97%.
“This survey attempts to cover all other PV products from China that were not included in the 2011 “Double-Reverse†survey, and also proposed anti-dumping against Taiwan, which is intended to form a comprehensive restriction on PV products in China.†China Chamber of Commerce for Import and Export of Mechanical and Electrical Products Relevant responsible persons pointed out that this kind of comprehensive restriction on the entry of Chinese PV products into the US market aims to abuse trade remedy and avoid legitimate competition of Chinese enterprises through unreasonable trade barriers.
Zheng Lepeng, executive vice president of the Guangdong Solar Energy Association, said that the scope of the survey, including the products assembled from solar cells, the companies involved will face a new round of blows.
In stark contrast to the "strict defense" of the United States, China's "double-reverse" measures against US polysilicon have not been effective. In July 2013, the preliminary ruling of the Ministry of Commerce of China determined that temporary “double-reverse†measures were taken for polysilicon exported from the United States and South Korea to China. However, the situation of low-priced dumping has increased. The customs data shows that since the "double-reverse", the average price of polysilicon imports in China has not risen and fallen, from about 20 US dollars / kg to about 18.3 US dollars / kg, and imported last year. The amount is about 79,000 tons, which is basically the same as domestic polysilicon production.
"Foreign companies seize the loopholes of 'double anti-" and export to China through processing trade at a price far below the cost, while avoiding taxation." The China Nonferrous Metals Industry Association Silicon Industry Branch report analysis pointed out that only November 2013 The proportion of overseas polysilicon entering China by means of processing trade is as high as 71%. Among the polysilicon imported from the United States, the proportion of imports by processing trade is as high as 98%.
At the same time, the amount of polysilicon imported from Taiwan increased to 792 tons in November last year, accounting for 10.0% of the total imports. Foreign polysilicon manufacturers sell polysilicon to Taiwan and then re-export it to China. The re-export trade from Taiwan has become another powerful measure to avoid "double opposition" after processing trade.
The industry believes that in the face of successive international trade wars, while taking active countermeasures, further measures should be taken to expand the domestic demand market and implement policies such as grid connection and power generation subsidies as soon as possible.
