You should know about these chemical regulations in 2017.

In 2016, with the successive introduction of various systems and standards for chemical management, chemical safety is becoming the focus of government regulation, the core of corporate management, and the focus of people's concern. In 2017, we also believe that with the development of society and the maturity of the chemical industry, more chemical regulations and policies will be released and implemented.
       For chemical industry practitioners, it is especially important to keep abreast of the latest regulations and policies. On the one hand, it can avoid unnecessary violations of laws and regulations; on the other hand, it can promptly and effectively implement countermeasures to promote the healthy development of chemicals.
       In this issue of Compliance Interpretation, we have listed some of the regulations and policies that have been or will be released/implemented by the chemical industry practitioners in 2017 on the theme of “Chemical Regulations and Policies” .


I. The latest implementation progress of global GHS
(1) United Nations GHS

       According to the "two-year-one update" practice, the seventh revision of the UN GHS system is expected to be officially released in the second half of 2017. According to the report of the latest meeting of the UN TDG/GHS Expert Committee, the “dust explosion” may be included in the physical hazard in the seventh revision; and the classification of some physical hazards will not only depend on the inherent nature of the chemical but also Reference quantity, packaging constraints and other factors; according to past revisions, the new system will also make minor revisions to some of the annexes. The specific changes will be based on the final release system, and the compliance chemistry will be revised and interpreted in the first instance of the new system.
(2) Some countries/regions GHS

       At present, the global promotion of the implementation of the GHS system mainly includes the EU, the United States, China and other countries/regions. In recent years, with the gradual popularization of the GHS system, many countries or regions have also joined the “GHS army”. In 2017, we should focus on the following “GHS freshmen”, as shown in Table 1.

Second, the latest implementation progress of the dangerous goods transport regulations
       The provisions for the transport of dangerous goods mainly include: United Nations "Model Regulations on the Transport of Dangerous Goods" (TDG), "International Maritime Dangerous Goods Code" (IMDG-CODE), "Technical Regulations for the Safe Transport of Dangerous Goods by Air" (IATA-DGR) , International Road Transport Dangerous Goods Agreement (ADR), International Rail Transport Dangerous Goods Code (RID), International River Transport Dangerous Goods Agreement (ADN), etc.
       However, due to the relatively high frequency of revision of transport regulations, many practitioners involved in the transport of dangerous goods are not fully aware of the latest developments in relevant regulations and policies, which in turn leads to confusion. In this article, Compliance Chemistry will take you through the progress of the major risk regulations for 2017, as shown in Table 2.

       At the same time, China's Road Transport Standardization Technical Committee issued a notice in November 2016 on the solicitation of the “Dangerous Goods Road Transport Rules” industry standard (draft for comments). From the technical content, this rule is completely consistent with ADR (2015 version). Without accident, the official standard will be released in recent years. At that time, China's management system for dangerous goods road transportation will enter a new level.


Third, other laws and regulations worthy of attention
(1) US TSCA

       On June 7, 2016, the US Senate voted unanimously to pass the Lautenberg Act (HR 276), which was signed and passed by Obama on June 22 and immediately came into effect. It is worth noting that the bill will directly lead to major reforms in the 40-year-old Toxic Substances Control Act (TSCA).
       The new law requires the US Environmental Protection Agency (EPA) to conduct a comprehensive assessment of existing chemicals and new chemicals in the market, and to conduct risk control over chemicals in accordance with the risk assessment conclusions, including notification, restriction, and prohibition. This decision will have a huge impact on producers, distributors, importers and downstream customers in the US chemical industry. From a regulatory perspective, the rigor of chemical regulation will be qualitatively improved.
       At present, the EPA has released the list of substances for the first batch of hazard assessments in December 2016, and will announce the material hazard assessment reports in other 2014 TSCA work plans in the later stages.
       For related companies, from 2017 onwards, we should always pay attention to and verify whether our product supply chain involves substances in the substance list, and try our best to avoid unnecessary losses in export trade.
(II) Comprehensive management plan for hazardous chemicals safety

       On November 29, 2016, the General Office of the State Council issued a notice on the comprehensive management plan for hazardous chemicals safety, which is the most stringent policy on the remediation of hazardous chemicals in recent years in China.
       The notice has made clear and detailed requirements and regulations for the comprehensive management plan for hazardous chemicals in the next three years (17 years to 19 years) in China, and is divided into three phases for implementation. The deployment phase (the development of specific implementation plans, clear responsibilities, and detailed measures) was completed in December 2016, and the most critical remediation phase from January 2017 to March 2018, during which the relevant departments and enterprises must be strict. Complete their respective division of labor in accordance with the relevant provisions of the notice.        It is not difficult to find that China's regulation of chemicals in the next few years will become increasingly strict and clear. In the middle of 2017, as a company, we should first understand the policy, strictly implement the relevant laws and regulations on production safety, and promptly respond to measures to promote the steady improvement of the safe production of hazardous chemicals.
(3) Measures for the management and classification of chemical physical dangers

       Although the Measures for the Administration of Chemical Physical Hazard Identification and Classification (Order No. 60 of the State Administration of Work Safety) has been officially implemented on September 1, 2013, the conditions for the identification and classification of chemical physical hazards in China have not yet matured. This management method has not been implemented.
       With the issuance of the first batch of chemical physical danger assessment agencies (the No. 7 Announcement of the State Administration of Work Safety, 2016) issued by the State Administration of Work Safety in November 2016, the implementation of the 60th order will be greatly enhanced.
According to the relevant person in charge of the Chemical Registration Center of the State Administration of Work Safety, the Catalogue of Chemicals Exempted from Physical Hazard Identification and Classification will be issued in the near future and the Notice on Strengthening the Classification and Registration of Chemical Hazard Identification will be issued immediately. , aiming to completely extend the 60th order.

       At the same time, considering that the dangerous chemicals registration certificate is valid for 3 years, and the new NRCC registration system is launched in 2013, there will be a large number of enterprises in 2017 that need to be re-certified. Therefore, the release of this series of policies has far-reaching implications for companies and regulators.
       Compliance Chemistry reminds you that the following chemicals not listed in the Exemption Catalogue must be tested, identified and classified in an approved laboratory issued by the State Administration of Work Safety before being registered for hazardous chemicals , otherwise they will not be recognized:
       Ø Chemicals containing one or more of the components listed in the Hazardous Chemicals List (2015 Edition), but whose overall physical hazard has not been determined;
       Ø Chemicals not listed in the Hazardous Chemicals List (2015 edition) and whose physical hazards have not been determined;
       Ø For the purpose of scientific research or product development, chemicals with an annual production or use exceeding 1 ton and whose physical danger has not been determined.
(4) Measures for the Administration of Safety of Hazardous Chemicals in Shanghai

       In September 2016, the Shanghai Municipal Government issued the “Measures for the Safety Management of Dangerous Chemicals in Shanghai”, which was officially implemented on January 1, 2017. This method has detailed requirements for the production, operation, storage, transportation, use and disposal of hazardous chemicals in hazardous chemicals in Shanghai.
       Shanghai is the gathering place of China's large national backbone enterprises (Shanghai Petrochemical, Gaoqiao Petrochemical, etc.) and famous multinational companies (BASF, Dow, Bayer, DuPont, Dow Corning, Honeywell, DSM, Henkel, etc.) It is the highest benchmark in China's chemical industry, so the method issued by the Shanghai government is also inevitable. From the perspective of policy content, the most mentioned vocabulary includes “forbidden”, “concentrated”, etc., which is enough to see the degree of rigor.
       This method has just been officially implemented this year. From the impact index, it will inevitably lead to a series of chain effects in 2017. Enterprises that are “in the scope of radiation” should promptly understand and implement the management measures to ensure the compliance of chemicals in production and operation.
